Awareness of Risk

I fully understand the nature of the activities I have chosen to engage in and I find no reason why I am physically or mentally unable to perform the required actions in order to safely accomplish these activities. I am fully aware and understand that the activities in which I am participating in under the arrangement of Volant, its employees, agents, and associates are potentially dangerous and that there are risks inherent in all outdoor activities. These risks include but are not limited to; inclement weather, hazards in walking, hiking on mountain trails, general outdoor activity, and travel by car, train, bus, boat, and aerial tram. Risks associated with such activities include but are not limited to serious bodily injuries, such as permanent disability, paralysis, and death. There are many risks that may arise from foreseeable or unforeseeable causes (i.e. rocks falling from above and hitting participants below). I understand that these risks may be brought about by my own actions or inactions as well as other participants and staff members of Volant actions or inactions. Any decisions made by guides, affiliates or employees of Volant are part of the risks of the activities listed above. I also understand that there may be other risks and economic or social losses unseen to me at this time. I fully accept all such risk and responsibilities costs, damages, and losses that may come to me in result of participating in these activities.

Medical Considerations

If you have any medical or psychological conditions, it’s important you let us know well before departure so that we can make extra arrangements if necessary. Volant and its guides have the right to disqualify anyone at any time during the trip if they feel the trip member is mentally or physically incapable to continue and/or if a trip member’s continued participation jeopardizes the group’s or his/her own safety. Volant reserves the right to provide alternative activities and onward transportation in situations where the guide determines that the participant is physically incapable of completing any day’s activities in a reasonable amount of time or if participation puts the participant at increased risk of injury. Volant is not a medical facility and therefore has no responsibility regarding medical advice, medications or inoculations that you or your doctor deem necessary for your safe participation. Hospital facilities for serious problems are often unavailable, and evacuation can be prolonged, difficult and expensive. Volant assumes no liability regarding provision of medical care. By registering for your trip and accepting these Terms and Conditions, you agree to pay for emergency evacuation and emergency medical care.

Your obligations as a trip member

By participating in a Volant trip, you assume certain obligations to Volant and the other trip members. It is your responsibility to:

    • Understand the conditions implied in the Activity Level rating of your selected trip. Select a trip that is appropriate to your interests and abilities.
    • Prepare for the trip by familiarizing yourself with the trip itinerary and trip preparation materials sent by Volant.
    • Bring appropriate gear and clothing as advised by Volant.
    • Follow considerate standards of personal hygiene in order to reduce risk of contracting diseases.
    • Follow considerate social behavior with other trip participants and respect their habits.
    • Respect the areas in which we travel by using environmentally safe products, staying on established routes of travel and not littering.
    • Abide by instruction/rules/outdoor ethics written or communicated by Volant staff or affiliates.
    • Volant reserves the right to decline to accept or retain any person as a tour participant should such person’s behavior, health, or mental condition impede the operation of the trip.

Trekking Tours

On our trekking tours, there are some additional risks that require that each member of the group stay reasonably close in distance. We expect all participants to maintain a pace on each hike of approximately:

  • 2.5 miles/hour on the flat.
  • 1200 feet of ascent per hour.
  • 2000 feet of descent per hour.

Our Legal Limitations-Please Read Carefully

Volant may contract with independent contractors to provide transportation, guide services and/or all other related travel services. We assume no responsibility, however caused, for injury, loss or damage to person or property in connection with any service provided by an independent contractor or resulting directly from the following: Acts of God, detention, annoyance, terrorism, thefts, pilferage, force majeure, civil disturbances, government restrictions or regulations, strikes, delays and expenses arising from quarantine, failure of any means of conveyance to arrive or depart as scheduled, discrepancies or change in transit or hotel services over which we have no control. We reserve the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of trip members. By accepting these terms and conditions and registering for this Volant trip, the participant agrees to be bound by the above terms and conditions.


I hereby release and discharge Volant, their owners, staff members, affiliates, agents, and employees, and their successors and assigns, from any and all liabilities, suits claims, and demand actions or damages (including attorneys fees and disbursement) incurred by me arising out of the participation in activities under the directions of Volant including without limitation, all claims for property damage, personal injuries, or wrongful death. This release is binding on my heirs, assigns, and agents.

Medical Release

In the event of an emergency, permission is given for any medical treatment provided by Volant its employees, agents, and associates, which might become necessary. I hereby authorize the leader of the activity to secure such medical advice and services as may be necessary for the health and safety of myself, and I consent to release all medical information the leader determines necessary to any medical provider. I also agree to accept financial responsibility for medical treatment. Hospital facilities, qualified medical care, and emergency medical evacuation may be limited or unavailable during portions of the trip and, where available, may be expensive. Volant assumes no responsibility for providing medical care during the trip, and I will have to pay for any medical care and/or evacuation that I incur. In consideration of the permission to participate in the trip, I agree to the terms contained in this document.


I hereby agree to indemnify and hold Volant harmless for any litigation expenses, attorney fees, loss, liability, damage or cost which any many bring about as a result of such claim, to the fullest extent permitted by the law. This release includes, but is not limited to, claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that Utah law does not permit to be released by agreement. I also agree NOT TO SUE or make a claim against the Released Parties for death, injuries, loss, or harm that occur on the trip.


Volant, its trip leaders, and Volant-authorized third parties reserve the right to take photographs or videos during the operation of any tour or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By making a reservation on an Volant tour, the participant agrees to allow their likeness to be used by Volant and Volant-authorized third parties, without compensation to the participant. If the participant prefers that their likeness not be used, they must notify Volant in writing prior to departure of the tour.

Pricing policy

All pricing is in US dollars. Quoted costs, specific accommodations and activities and times are subject to change and availability until a firm reservation is secured. 

Payment policy

A deposit will be made to secure any reservations. This will be clearly displayed on your itinerary. If making a reservation within 45 days of your tour commencement full payment is required upon confirmation of all your arrangements. This deposit is non-refundable once your itinerary is confirmed.

Full and final payment

Full and final payment for the balance of your tour costs is payable 45 days prior to your tour commencing. This date will be clearly displayed on your itinerary and documentation. We accept payment made on Volant.travel with all major credit cards, bank transfer and PayPal/Venmo payments are also accepted upon request. 

Amending or Changing Your Tour

If you wish to make any changes to your trip we will of course make every effort possible to accommodate these but please note that we cannot guarantee that this will be possible. Please note that some of the more popular niche products like guided hikes and prepaid items such as flights or hotels over peak travel dates are also unlikely to be changeable or cancelable. If the amendments you request are indeed possible then they will be subject to both any amendment (or other charges) imposed on us by the effected suppliers and a service fee to cover our administrative costs. Requests for amendments need to be made in writing to your consultant by the person who made the original booking. If we accept a request to transfer you from one tour to another you will be liable for any costs imposed on us by our suppliers for the cancellation of your original tour. We also reserve the right to charge an administration fee of up to 20% of the value of the first tour booked if needed. We can change the entire date of a confirmed tour once only on these terms. Further and subsequent date changes will be treated as a cancelled booking and then will need to be re-booked and cancellation costs will be applied. Please also bear in mind that amending the dates may alter the actual cost of the tour. Many insurance providers can include cancellation or interruption cover and therefore fees imposed by us or our suppliers may be recoverable however it is your responsibility to ensure you are adequately covered.

Cancellation policy

Cancellations made between 90 and 45 days prior to departure are subject to a per person cancellation penalty of $1000. Any cancellations made fewer than 45 days prior to departure are completely non refundable. Changes made en route are subject to a service fee. Cancellation of individual room nights or non-use of prepaid meals are not refundable. Pre-paid train tickets, excursions, and hotels nights are subject to additional penalties. 

Final payment for your trip is due 45 days prior to your trip departure. If payment has not been made by this date, we reserve the right to cancel your trip reservations. 

If a guided tour does not meet the required minimum number of participants, we reserve the right to cancel the trip 90 days prior to departure. In that case, we will fully refund any payments made to Volant. 

We do not issue refunds for any activities, meals, accommodations, or other features included on a guided trip that you may choose not to use.  

Privacy and Data policy

The data you supply to us via enquiry forms or when communicating with us via email, phone or any other method is used by us in the process of answering your enquiry or providing you with options concerning trips with Volant. 

If you decide to make a reservation with us we may share limited information with our suppliers to enable reservations to be made such as names, country of origin and ages (to ensure that suitable and correct services are supplied), We do not share email information or any other contact details with other parties. If you have consented we may use your information to contact you in relation to your trip. 

Any marketing emails from us will give you the option to unsubscribe. On request you can see all and any data we hold about you.

Our rights

Volant reserves the right to amend pricing at any time. In the event of an amendment to an itinerary that is beyond our control some services and products may be replaced.

Any information provided is done so with the understanding that the information may have been provided by a third party and should therefore only be used as a guideline. Volant may use third party suppliers or providers of some services and products and as such acts as agents for those suppliers. Any claim or liability resulting from those services or products is the responsibility of the supplier or provider.


We recommend you seek local and professional advice on your specific insurance needs at the time you make your reservation. Many insurance providers can include cancellation or interruption cover. This means that should your flight be delayed or cancelled or you need to amend your plans due to illness or other unforeseen circumstances then fees imposed by us or our suppliers may be recoverable. Check with your insurance provider and ask the question. It is your responsibility to ensure you are adequately covered.

This is a legal binding contract

I have read and fully understand this agreement and am fully aware of its content and context. I understand that this is a legal contract and that this is a release of liability. In submitting this tour reservation and payment of deposit of my own free will, I agree to the terms and conditions set forth above. (If participant is under age 18, the signature of parent of or guardian below indicated their agreement to the above conditions.)
